Lausanne – In the context of the sale of its Engineering Services business, which was concluded in 2018, the purchasing party Bouygues Construction, in its detailed arbitration claim that has now been submitted, has increased the amount of its claim against Alpiq from CHF 205 million to a new total of approximately CHF 319 million plus interest. Alpiq forcefully disputes these claims.
On 12 February 2019, as previously announced, Alpiq and Bouygues Construction both initiated arbitration proceedings pursuant to the arbitration regulations of the Swiss Chambers’ Arbitration Institution and asserted mutual claims for the adjustment of the purchase price. In addition to the existing differences between the parties regarding the definitive adjustment of the purchase price, Bouygues Construction is now also asserting warranty claims. Alpiq also forcefully disputes these new claims by Bouygues Construction, both in terms of their amount and substance, and will challenge them during the course of the proceedings specified by the arbitration court. A decision by the arbitration court can only be expected in the course of 2022.
